TEA TIME: The Update You’ve Been Waiting For Hey guys! A few months ago, I told you how I found out that Nordstrom Rack was selling a straight up dupe of my patented Pirouette Skort. Get ready, it’s tea time. First, let’s recap what happened.   Basically I found out about the dupe, which is by a brand called Gottex. I sent a cease and desist because wellllll my design is PATENTED and they responded with a threat to sue ME. So I posted a video about it. I gave them a chance to fix it. I gave them an easy out. I told Nordstrom, “Hey, let’s turn this into an ‘enemies to lovers’ arc.” All they had to do was reach out and get the real thing in their stores. It would’ve been a win for everyone… a PR win for them, a victory for me, and a win for YOU because you’d get to shop one of our favorite things in-store! But instead, nothing happened. Months went by with no resolution and no one getting back to me. I was tossed around like a hot potato between lawyers, retailers, and manufacturers. Like if they gave me the run around I would just… go away? The disrespect. After I shared the truth about the Nordstrom dupe with you all, things took a turn. News outlets picked up the story and you started showing me receipts! Turns out Nordstrom Rack isn’t the only one selling this skort, but also TJ Maxx, Marshalls, and Beals. Why didn’t I know about these other stores earlier? Something didn’t add up. Shady much? And how convenient that THIS is when the lawyers finally decided that they had time to respond. Only instead of apologizing or trying to work with me, things got worse. The lawyer literally said, “We request that your client remove all defamatory remarks.” Excuse me? Defamation? I’m just stating the facts. They took my design, and I’m calling them out. A Pirouette dupe at TJMaxx! How can they copy it down the the color that went viral after the Taylor Swift ICDIWABH music video and just pretend like it’s their own original design? No.   This should speak for itself. The NDA. After we finally had people talking to us, I proposed a settlement to simply end the madness. Just pay me a fair royalty, stop selling the dupe, and we’re done here. But no. THEY CAME BACK WITH AN NDA. And not just any NDA… this one said I could NOT talk about the situation on ANY platform. Instagram, TikTok, Twitter, LinkedIn, Facebook, YouTube… they were very specific. And if I did post about it… they would fine me $250,000. Umm excuse me?! Hard no. I’m not signing their NDA. I won’t be silenced and you cannot buy me.  In fact, I’m going to keep talking about this because truth is on my side, and I’ll NEVER be bullied into silence. Nice try though. One of the largest retailers in America is trying to silence me One of the largest corporations and retailers in America is not only selling a dupe of my patented Pirouette Skort design, but they also threatened to SUE ME for speaking up about it. Yeah. When I sent a cease and desist to stop selling the dupe, that’s the response I received from their legal team. On my birthday, btw. Here’s the dupe, the “Tutu Skort” by a brand called Gottex. I mean, they even had ZERO SHAME making the exact same color as my lilac Pirouette that went viral after Taylor Swift wore it. The other two color options are also exact copies of POPFLEX colors. Did they not think anyone would notice? Or do they just know they’re the big fish and bet on me doing nothing about it? Prob the latter. Nordstrom is worth 4 billion dollars. They have 54,000 employees and 351 stores in the US. But they chose to infringe on my patent instead of oh…idk… WORK WITH ME?! SHOP PIROUETTE SKORT Fun fact: I was granted the patent for this skort (my very first design patent!) on my birthday last year! The application process takes a lot of time and effort, which is one reason why they are not always an option for small businesses. And as you can see, a patent doesn’t always deter a big corporation from stealing a design. Sadly, my story is nothing new. Corporate America is full of twisted greed, where big corporations steal an independent designer’s creation and make money off of the product while the original designer goes unpaid. Instead, they pay their lawyers to gaslight and threaten to sue anyone who tries to fight back. But nah. HBD to me and my first design patent! In honor of celebrating my birthday AND the one-year anniversary of my very first design patent, I wanna give a very special shoutout to SHEIN. Yeah, you read that right. We give credit where credit is due, right? If it weren’t for them stealing my Pirouette Skort design (ahem, twice), I wouldn’t have applied for my very first design patent. I wouldn’t have been granted that patent one year later, ON MY BIRTHDAY. Best gift of my life.   View this post on Instagram   A post shared by Cassey Ho (@blogilates) Two years and 499 dupes later Receiving that patent on my birthday was like a really weird sign that I was on the right path. Since then, we’ve now taken down 393 dupes of the Pirouette Skort alone. INSANE. Now, design patents are NOT easy to get. They’re incredibly expensive and the application process is extremely time consuming and confusing. It’s very difficult, which is why you don’t hear about many designers going this route.  That said, having a design patent is the most powerful tool I have in my pocket for protecting my rights as an independent designer. And I’ve simply had enough of dupers. Enough. I’m so happy to share that in 2024, I was also awarded a patent on my Corset Pirouette Dress, the Superbra®, the Sklegging, and the Hiking Superskort. I am so weirded out…dupe culture, exposed. Hey guys, Dupe culture = counterfeit culture. There, I said it. No one wants to hear it but it’s true, and it’s getting absolutely out of control. I’m sharing with you what’s been happening with me because I am terrified of the future of dupe culture, especially with its popularity being propelled by the use of AI. There is really no point in trying to explain any of this to you through writing…so I want you to watch this video. You have to see it to believe it. The video is about 5 min and 40 sec – kind of long – but trust me, you will want to watch all the way to the end. It just gets weirder and weirder… First, let’s set the stage. My Pirouette Skort was first stolen by SHEIN, twice, and then duped numerous times all over Amazon. I eventually was awarded a design patent for my skort in hopes of having some protection. Well, it’s only gotten astronomically worse after Taylor Swift wore it this spring. Grateful forever , however, the extra exposure opened the floodgates for the counterfeiters to hijack the opportunity. There are dupers coming out from every corner of the internet and I am getting so exhausted trying to whack-a-mole each one. Actually, it will probably get worse. AI is making it way WAY too easy to steal designs, falsify images, and trick consumers into buying fake, lower quality products. It’s a lawless place in the world of fashion and no one’s paying attention to these crimes except for me and my small team, who are often notified by you guys in the DMs. Thank you for watching out for me as this becomes a bigger and bigger problem. This package just made me cry

This package just made me cry The past few days have been a dream I cannot even begin to explain how magical all of this has felt…and I am not talking about the sales or the press mentions, but the genuine FEELING of community and support. I remember when my Pirouette Skort design first got stolen by SHEIN and I wrote about it, there was so much negative chatter. People saying that I need to shut up, that there was nothing special about my design and that they could draw it in their sleep. About a year later, I get issued my first patent ever…ON MY BIRTHDAY of all days (Jan 16) and I release a video with Karma (Taylor’s version not Jojo’s lol) as the backdrop of the vid. I end the vid by stabbing a blank space cake with SHEIN written on top. The package that made me cry Anyway, today I just received one of the most thoughtful gifts ever from Rosie and Brenda’s Sweet Treats and I cannot tell you the range of emotions I experienced as I unwrapped each cookie.
